1. Acceptance of These Terms
These Terms of Use govern your access to and use of alchemyinthekitchen.com and related pages operated by Alchemy in the Kitchen, LLC (“Alchemy,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. Purpose of the Site
The Site provides information about Alchemy, its food and beverage product-development, commercialization, sourcing, and related services, as well as educational and informational content concerning food and beverage development, manufacturing, commercialization, and the CPG industry.
Website content is provided for general informational purposes and does not constitute a project-specific recommendation or engagement.
3. No Client Relationship
Accessing the Site, reading our content, contacting Alchemy, or submitting a project inquiry does not create a consultant-client, advisory, fiduciary, agency, partnership, joint-venture, or other professional relationship between you and Alchemy.
Alchemy becomes obligated to perform services only through an applicable written agreement or other written engagement accepted by Alchemy. Alchemy has no obligation to accept, evaluate further, or enter into a business relationship concerning any inquiry submitted through the Site.
4. Confidential Information
Personal information submitted through the Site will be handled in accordance with our Privacy Policy. Confidential business information, formulas, processes, trade secrets, specifications, supplier information, pricing, and similar proprietary information are governed by any separate written confidentiality agreement entered into by the applicable parties.
5. Separate Agreements Control
If you or the organization you represent enters into a Master Services Agreement, Non-Disclosure Agreement, Order, procurement agreement, manufacturing-related agreement, or other written agreement with Alchemy, that agreement governs its subject matter.
If these Terms conflict with a separately executed agreement between you and Alchemy, the separately executed agreement controls with respect to that conflict.
6. Ownership of Site Content
Unless otherwise indicated, the Site and its content—including text, graphics, photographs, designs, logos, articles, downloadable materials, and other original materials—are owned by Alchemy or used with permission and are protected by applicable intellectual-property laws.
You may access and use Site content for ordinary personal or internal business reference purposes. Except as permitted by law or expressly authorized by Alchemy, you may not reproduce, republish, distribute, sell, license, modify, remove attribution from, or commercially exploit substantial portions of Site content.
7. Automated Access and Scraping
Alchemy permits ordinary access by search engines, answer engines, and similar automated services for legitimate indexing, discovery, citation, summarization, and presentation of limited excerpts, subject to applicable law and technical controls implemented on the Site.
You may not use automated means to circumvent technical access controls, impair Site operation, conduct abusive or excessive scraping, reproduce substantial portions of the Site, or compile Alchemy’s Site content into a commercial database or competing content repository without permission.
Nothing in these Terms grants intellectual-property rights beyond the limited permissions expressly stated here.
8. Acceptable Use
You may not use the Site to violate applicable law, interfere with Site operation or security, attempt unauthorized access to systems or data, transmit malware or malicious code, impersonate another person or organization, or engage in fraudulent or deceptive activity.
9. Third-Party Services and Links
The Site may contain links to or integrations with third-party platforms, including project-intake, analytics, social-media, mapping, or other services. Alchemy does not control those third-party services and is not responsible for their availability, content, security, terms, or privacy practices.
10. Informational Content
Articles, guides, commentary, and other content published by Alchemy are intended to provide general educational and industry information.
Food formulation, processing, manufacturing, labeling, regulatory requirements, shelf life, food safety, ingredient performance, and commercial outcomes depend on facts and circumstances specific to each product and production environment.

11. No Warranties
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Alchemy disclaims warranties regarding the availability, completeness, accuracy, timeliness, merchantability, fitness for a particular purpose, and non-infringement of Site content.
We do not warrant that use of information appearing on the Site will produce a particular regulatory, manufacturing, financial, commercial, product-development, or business outcome.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Alchemy will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of, reliance upon, or inability to use the Site or Site content. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Changes to the Site or Terms
Alchemy may modify the Site, discontinue Site features, or update these Terms from time to time. The current Terms will be posted on this page with the applicable effective date. Continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent a dispute arising solely from use of the Site is properly brought in court and is not governed by a separate written agreement, the parties consent to jurisdiction and venue in the state or federal courts located in Orange County, Florida.
A separately executed agreement with Alchemy may contain different dispute-resolution provisions, and those provisions control disputes governed by that agreement.
